Frequently Asked Questions (FAQs)
Do I need a lawyer or conveyancer to buy or sell property in Queensland?
While not compulsory, engaging a solicitor or licensed conveyancer helps ensure the contract terms, searches and settlement are handled correctly and reduces the risk of costly mistakes.
What is a standard contract of sale and what conditions should I include?
The REIQ contract is commonly used for residential property and may include conditions for finance, building and pest inspections and due diligence to protect the buyer.
What is the cooling-off period for residential property?
Most Queensland residential contracts include a five-business-day cooling-off period during which a buyer can terminate the contract by giving written notice and paying a termination penalty of 0.25% of the purchase price.
Are stamp duty concessions available for first home buyers?
From 1 May 2025, eligible first home buyers pay no transfer duty on a new home, or on vacant land on which to build their first home, regardless of value. For established homes, first home buyers may receive a concession on transfer duty for purchases up to a certain value, reducing or eliminating the duty payable.
When is settlement day and what happens at settlement?
Settlement usually occurs 30 days from contract date or as agreed; the buyer pays the balance of the purchase price and legal title transfers to the buyer, at which point keys and possession are handed over.
